David: Hello, and Welcome, SLE. Thanks for making it here in the dark of daylight savings to attend our semi-annual Homeowners Association meeting tonight at Cup of Grace. We hope you’re enjoying making this our regular meeting place to expose more residents to this wonderful charitable organization. It would be great [to support their work with your donations], and we are coming up on the Thanksgiving season, so whatever you can do out of generosity of your heart, please do so. Today is Veterans Day. Thank you to our Veterans. Show of hands for Veterans in the room, please. Thank you, very much.
Okay, first thing we will do is the minutes from the last meeting. I need a motion to accept the minutes from the last meeting which have been posted on the internet. I motion. John motions and Brian seconds. All in favor? Aye. Okay, motion passed.
We now go in, oh by the way, we're going to have this thing done by 8 o'clock for sure. The format is that we'll go through the business part of it. The board will vote on acceptance of what's been presented. There will be a short period for discussion from the membership at large. We'll put a limit of two minutes approximately on how long you can lash us or give us your input and then we want to move on.
We want everybody to have an opportunity to comment. We do have a limit for each segment. For instance, on the Treasurer's report, there will be a 10-minute time limit, max. If we haven't finished it up by then, we'll cut it off, and move on to the next. It's all choreographed carefully so that we are done by 8 o'clock. Then we get the chairs back and everybody's out of here by 8:30pm, so we can go home, and watch Matlock. All right, so we'll get into the Treasurer's report.

Intermax renewed its newsletter & social media advertising, so we’re looking forward to that too ($1,100).
5 PROPERTY OWNERS ARE DELINQUENT ON THEIR DUES (TOTALING OVER $900):
That’s $904.31 in unpaid dues that still needs to be settled-up before 2026 bills go out. If dues from 2025 are still owed once 2026 bills are officially late on March 1st, those owing both will have liens filed.
Reminder: PayPal, by unanimous agreement [is being removed, end of Dec]. We're switching to a new service where members can pay by credit card, which is what a lot of you [ask], can I pay by credit card?
With this new service, you'll be able to pay by credit card and that service fee is automatically added onto the credit card charge that gets sent to your credit card. So, it'll be your HOA dues plus the 3% service fee of the credit card automatically charged to you. Because what we were finding is when using PayPal, we would have to ask the homeowners to add that 3% on [to receive dues payment in full].
And a lot of times, it didn't get added on. It became just a 3% little bill that either the HOA ends up eating or just gets tacked onto your account as a past due amount. And it's ridiculous to give you guys a 3% past due amount when it's just an oversight. We're trying to make it easier and a bit more [user-friendly].
The cost of that is going to be $15 a month for that service. And it's going to be turned on January 1st until [end of] March. So, we'll have three months of that service for everybody. And hopefully everybody will pay their HOA dues in the first three months and we will be done with it. We won't be dragging on.
This year, I will say, with the help of David Peterson, President, he did a great job of helping me collect a lot of these outstanding HOA dues that were past due. So, we're actually doing really well on that.
David: When I took on the job of trying to collect on the overdue accounts, we had 40 accounts that were past due.And four of them that were multiple years. We've chipped away at that through the help of the Board members and personal interaction. And we got it down to where, what, $900?
I'm not patting myself on the back, but really what it comes down to is communicating with people, and there were some people who said, you know, I'm really sorry about this, it wasn't intentional. It's one of those things, and we got it solved. So, we've got more money in the bank because we've been diligent about contacting these people.
Also, on the 3% credit card fee, when you go in, and buy your tags for your vehicle, you have a choice. Cash or debit, or if you use a credit card, they'll add 3%. There's really nothing more that we're doing here. We're just covering our expenses. And you can always pay by check, you don't have to pay by credit card. You can always write a check, mail it the old-fashioned way.
Brendan: Maybe [I can set some hours] a couple weekends where I'm down at the HOA shop, just making myself available, to see [how we can help people] to get their dues bill paid. So, if that's a need, I could put that out there. I don't mind doing that—volunteering my time—to help you guys out.
David: Also, you know, although we don't want to turn into a pay-by-month system—there's a lot of paperwork and accounting that goes with it—if somebody's in a jam, we'd rather have you say, hey, listen, things are tight, can we make this a payment schedule? And we're more than happy to do that. Just make sure that if you agree to that, that you keep your part of the bargain.

Roads Report (Jon Dore, Road Chair):
We are trying, as you guys can see, to grade as much as possible. Just enough rain, not too much rain. We started on 10/12 [then graded more on] 10/24, 11/7, 11/8. We'll continue to grade as we can here.
I just want to address the people on North Priest River and South Priest River, the West end of Liberty. You haven't been forgotten. But I do have to hit these main roads first. So, we will try to get everyone's roads taken care of before winter.
It only helps our plow trucks [to get] these roads really dialed in. And hopefully we actually get a winter this year. Last year was super tough with the warm weather we had, the ice…the melting…it really put a beating down on the plow trucks, which leads me into the next item I've got…
All the trucks are up and ready right now. The maintenance has been done on them. The chains have been fixed.Thanks to Gus Ferguson, I think he donated 30hrs to weld the one snow plow blade back up. So, the trucks are tip-top as well as the grader.
I'm just hoping we get some snow. That's our main thing. Once we can get some snow, and get a [ice] pack down, things will be better. But until then, we will continue to grade as much as we possibly can.
When we get the heavy rains, the roads come apart. Those potholes just start showing up. I know CDA is looking pretty good. Liberty was pretty bad, and it's gotten better. I know we still have to do St. Joe and Hayden and some other roads out there. But we will get to all of them.
Like I said, it just helps us with the plow trucks, taking it easy on them through the wintertime. So, [please] be patient. We will get to you guys.

The weather changes…like with plowing and sanding…Joe Sandbank and I are up super early in the mornings, and we're on it with the weather.
A lot of times, if it's cold for just a little period of time in the morning, we'll wait on sanding because it will warm up in the daytime and then that sand falls through. So, we [have to] pick and choose there. We want safety as ultimate, but we are constantly monitoring the weather for that.
Our sand corral is completely full, diesel tanks are topped off. So, we’re ready for a winter, if we get one. That is all done.
When the grader is out, I know he goes slow, and I know he takes up a lot of room, but [please] just wait for him to wave you by, he does see you. Some people aren't so patient, and I think it just leads to some dangerous situations when passing in some of the corners.
Like I said, he knows you're there. He's just trying to look for a spot where he can see through the corner and wave you around. So, if you could wait for him, he'll give you the wave out the window or the door. He almost always grades with the door open. So, Jake and Joe are really good, and super aware of that.
I ask everyone to try to do their part. I know, I can tell, when the roads are good because speeds pick up. I see just about everyone that goes out of CDA as I'm at the end there, so I'm constantly monitoring.
Driving on the roads, we have posted 15mph speed limits. Sometimes it warrants slower than that. So, you know, it's just common that we have it posted. It's up to the individual to understand conditions. We want everyone to be safe out there, especially just past my house we have the S-turn right there. Sometimes it gets a little narrow, and people go a little fast on that, and there can be issues there.
So, please drive safe.
The last thing is we're trying to replace the mailboxes on Liberty at Hayden. I know the trash cans that their mailboxes are set in are looking pretty rough, and I know Rachael from the post office said she's responsible for hitting those every once in a while. But it's hard for her to get close to the mailboxes and not have to get out of her car.
John Bartholomew is volunteering time to replace those with one single wooden post with all the mailboxes on there. He unfortunately had a medical emergency in his family, is out of state right now. So, I believe that's going to end up having to get pushed back to the spring.
But we are always aware of our awesome mail lady, Rachael, and we're trying to do what we can to keep her route easy and safe for her. So, I just wanted to keep you updated on that.
When we do plow, there will be a berm in front of your driveway. We don't mean to do that.
Unfortunately, that will be up to you guys to clear. We just don't have the time [or] money to make sure everybody's driveway is clear. If you do take your tractor, I know a lot of people have their own tractors, and they’ll take the snow and push it over across the road to their neighbor, and that's fine if you have that agreement with your neighbor.
If you can just make sure the road is cleaned up, because if that freezes, then that's usually running in the opposite direction our plow trucks are running when they come out, and it's rough on the blades when those guys hit that. So, I understand, and that's fine to clean up. If you've got to go through the road to get your driveway clear, I totally understand that.
But just please try and get it as clean as possible and know that we're not doing it on purpose. That’s it.

So, you don't have a copy in front of you to refer to, but that's just not the way the process works. You'll be able to see what we talked about. You know, these are [just] canned agenda items that we've had to put in, so that we can remember to cover everything.

ARC Report: James says, nothing new to report. Since last month—our last meeting—no one has contacted us about any new building they’re doing. If you are building, there’s a form on the site, fill it out to the best of your abilities, and we’ll approve it from there, provided that it’s legal.
David: And the Architectural Committee's purpose is to just make sure that somebody is not putting the building right on the property line or they're doing something that is clearly against HOA rules and CC&Rs. We're not here to micromanage how you decide to build your barndominium.
But we do have to have an oversight. And there are protocols and things that we have to go through to get it approved. We're not, our Architectural Committee is not here to make it a stumbling block. The county will be happy to do that for you. We're just here to look over the shoulder and say, yes, looks good. James has got some input on how they're going to be changing the form to make things go easier.

Timber Report: (John O’Neil presenting for VP & Timber Chair, Gus Ferguson). Gus says, burn season is now open. If anyone is still needing to clear those slash piles while [it’s] raining, it’s a perfect time to burn. There's still time to clean up around your property—especially along our roads—which need to be free of all branches, trees that may impeding or could potentially be, particularly with snow load. Please remove them before it starts snowing to protect drivers, plows and crews.

OLD BUSINESS
No Soliciting Signs (Brendan) – At the last [semi-annual] meeting, we did discuss or a suggestion was made from a homeowner that we put the bus signs that I took down that were in the middle of the community because the buses don’t come into our community anymore—they stop out on the [Highway] 54—take those signs and put them out at Coeur d’Alene entrance and St. Joe entrance, deep enough to where people coming around the S curve when you go out Coeur d’Alene or St. Joe, people are aware that school buses stop out there, and sometimes there are kids in cars that stop right there.
With the delay in work that they had on the 54, I don’t know if they are done. They are going to put a skirt or approach coming into our community.
Jon (Road Chair): No, all the approaches coming off the 54 are temporary. They’re going to tear them back up in spring. So, they will come in farther up CDA, and eventually, St. Joe, when they get there. I think that would be a good time we can do the signs. Then, I’ll also look at maybe trying to widen CDA right there by my house because I know when parents are parking right there on either side of the road, it gets super tight when the kids are getting dropped off (and picked-up). So, we’ll try to make a little more room there.
Brendan: I think they did that on St. Joe, and it’s actually quite good, it’s a lot wider. But what I’m going to do too, is take a look at all the signs—too many signs, in my opinion—covers a lot of stuff. I’m going to see what I can do to consolidate the signage, saying the same things, but maybe less signs, better visual.
Hopefully it’ll be done [the Highway 54 project] next spring. Then we’ll be able to address the signs for people coming and leaving from the community.
Jon: Speaking about signs, I do have the Spirit Lake East sign that Scarsella asked me to take down while they were doing work. The sign was kind of broken in half. So, I’m repairing that now, and I’ll get that up within the next week. I know it was a nice monument to see where the road is on those dark nights. So, we'll make sure to get that back up ASAP.

NEW BUSINESS
No Soliciting Signs – David: Brendan took some of my thunder here. We’re going to be making some changes we want to have No Soliciting signs so we don't get the asphalt treatment or meat packing salesmen come through, and we're left alone in our privacy, which is what we want, why we moved here. So, that will get fixed. We also have Intermax still doing set-up, they're trenching for no charge. Lawsuit –Now here's the most important thing. We're being sued. Ten days ago, a resident of SLE filed a small claims lawsuit against our association in the amount of $5,069.00. This was filed by Frank Shupp who lives at CDA and Priest River Drive. His claims include 1. Theft of private property 2. Destruction of private property 3. Quality of life interruption and 4. Not enforcing the CC&R's.
So, the roots of this go back to March 2024 when [we now know from this filing] Mr. Shupp illegally blocked the end of Priest River Dr. with two concrete barriers, a chain and a padlock. He had no authority or permission to do so. That's public access, public utility, fire exit, all these things.
Gus Ferguson contacted every utility, every public agency to find out if that had been placed by them for good reason. They all said, no, please remove it. So, on April 2nd of 2024, a work crew was formed, we removed the barriers and placed them in storage, once again opening up the public access.
Now, this is all public record.
It’s not like I’m trying to shame Frank Shupp. But it is what it is. He doesn’t want any traffic on the road way in front of his house, and this is the section from Coeur d’Alene out Priest River Dr.
He has taken drastic measures by doing this. There have been some incidents where he has physically tried to prevent motorcycles and ATVs on that road-way, in illegal fashions.
We do have Sheriff’s reports on this.
When we did this removal, it was fairly public. We posted it on NextDoor. It was a community effort. There were pictures posted [the same pictures used by Mr. Shupp in his filing, so we know he saw it].
There was a member of the [Kootenai County] Sheriff's Department (off-duty) present when it happened [as well as the Chairman of the Spirit Lake Fire Protection District’s Board of Commissioners], so this wasn’t a theft.
When he, Mr. Shupp, filed his lawsuit, he made a sworn statement to the court that the facts that he presented were true and correct, upon penalty of perjury. It appears as though there is a problem with his statement, and that’s going to be brought to the attention of the court.
We have investigated this matter thoroughly.
We’ve taken the statements, we’ve got the Sheriff’s Reports, other documentation, and we are vigorously defending the lawsuit. Nothing to worry about. But you needed to be informed that a member of our community is suing, not the Board. He is suing you. So, something to consider.
If there was some real legal issue, then I guess bad on us, but there isn’t. So, this is a frivolous lawsuit, which will be defended, and I’m sure we will prevail.

Treasurer’s Report
Resident [hard to hear, paraphrased]: When do I get my bill? How do you have my address?
Brendan: The HOA dues are due on January 1st.
David: The mailings go out in December.
Brendan: Also, sometimes we get new people who move into a property, and [title co.] drops the ball, they don't give us their contact info. So, every once in a while, when we do get new people, new neighbors, reach out to them. Just, hey, does the HOA have your contact info? Or just kind of make that link. That's what we found when we were calling people throughout the year.
Bryan: Also, about the email thing that was last year, there was a bunch of confusion…incorrect emails were out there. Some people didn't get the notification to make the payments for your annual.
David: This year we're mailing them, snail mail. It'll [mail-out] this year. We thought we were being clever by emailing it.But emails change. People get spam folders, things like that. So, it's going out by mail.
Road Report
David: Any questions on the Road Report? Come on. It’s the most contentious item in the subdivision.
Resident (hard to hear, paraphrased): I have a question. Why do the potholes keep coming back? You put gravel in them, why do they come back?
Jon: A lot of it has to do with the speed going through there, especially in the turns. There are certain sections where the soil is just not good. I know, there's some on Tahoe and Newman.
St. Joe has a couple of areas that always come undone. We're trying to get better material in right now. Scarsella has got a big pile of the grindings from Highway 54 that they need trucked out of there.
So, they made me an offer last week, but I think if I hold out until the spring-time, I can get a better deal because they'll be needing to get that out of there.
Unfortunately, I can't spend any money right now on bringing in rock because where we're at with finances and I want to make sure we are covered in case we do have a bad winter. But rest assured, we know where those spots are that constantly come up, and we will address them as soon as possible.
David: Sir, I saw your hand raised. I'll get to you in a second. I just want to mention one of the reasons that we see these potholes show up when it's wet is a thing called hydraulic ram. When water's down in the soil around like a rock—even the size of my chew can—the car rolls over it.
Water doesn't compress. It hits that rock because we're going too fast, blows particles of roadway out. So, the faster we go, this hydraulic ram keeps ramming that and destroys the roads. That's the hydraulic ram effect. If we slowed down, it would be better. It'll never be perfect because of the base.

Resident (hard to hear, paraphrased): We live out on East Coeur d’Alene Drive…they put [underground] the Intermax cable (fiber internet), and also buried electrical cable—couple of years ago—we still have ditches (settling areas from burying the lines in the road last year) across the road that have not been addressed by the grader.
I was out working around in my front yard one day when the grader operator comes up…this was early last spring…and I mentioned to him that there was a lot of places between here and Sand Creek and up Sand Creek…up to the end of the road by the airport, by the runway, and he said, I’ll take care of that.
So, he goes over and he's right in front of my place, and he drops his blade straight across the road, drives up, fills my holes. He's gone about 30 mins and came back. We had to go to town that afternoon, so we headed out…going that way…that blade had never hit the road after it left my place.
Jon: Ok.
Resident: Very, very, very poor use of expensive machinery. He could’ve easily filled 10 of those trenches that they had dug putting that cable in that all got poorly compacted by the [construction] people. We know that. It’s not your guys’ fault, but it winds up being your problem.
So, now there's still a lot of dips, and they go all the way across the road. It’s not like just once in a while.
Jon. Right.
Resident: Plus, there’s some big potholes, and we haven't seen the grader there since earlier this spring.
Jon: Ok.
Resident: He basically did practically nothing.
Jon: Alright. Noted.
Resident: If you guys need an operator, I’m an operator too.

Resident (paraphrased): Does that road go to timber (paper) land?
David: It crosses into Paper Land, and then within a few hundred feet, it passes into State Land.
Same Resident: Because our son’s truck was damaged before those things were removed.
Husband of Same Resident: We believe this person tractored some bolders…
David: Yes, I remember meeting your son, we talked to him. I’ll get your name at the end so we have it.
John O’Neil: You did not say where the barriers are now.
David: Where they are now?
John O’Neil: Yes.
David. Yes, you are correct. I did not say where they are at. They are in safe storage.
Resident (paraphrased): Where does this resident live?
David: He lives on Priest River Dr. at the intersection of Coeur d’Alene.
Resident (paraphrased): So, the person lives on Priest River Dr.?
David: First house on the left as you’re going on Coeur d’Alene onto Priest River Dr., on the left (REMINDER: Mr. Shupp made his address public in the court filing. It’s also of public record online).
Bryan: What’s the back road there [leads out to], 10th?
David: Yes, that goes into the countryside…what it comes down to is motorcycles go out there, ATVs go out there. They do it at night. They make dust. Ok. We live in the country. It’s just part of where we live.
Resident (paraphrased): I wish all the motorcycles would slow down. They go fast down our road too.
David. There you go. Ya, they go fast. Ya, they go passed my place on Hayden fast too, and part of me wants to throw a rope across and catch ‘em. But can’t do that. So, anyhow, we have until [Nov] 19th to file a response to the lawsuit. We will be doing that and we’re exploring all legal options.
Resident (paraphrased): Who’s your attorney?
David: We are not using an attorney. You can’t use an attorney in Small Claims Court. You can consult them. But they can’t present the case. So, this is a peer-to-peer lawsuit overseen by a judge, and there’s a dollar limit, which is apparently is $5,000, what he is suing us for. Ok, any other questions on this?
